During the hearing on Tuesday, Chief Justice Mahesh Chandra Tripathi indicated that the court would address the issue but would not permit unlawful detentions. The Bench instructed the petitioner to provide specific instances of detentions for the court's review, emphasizing that while not all detentions are prohibited, each case needs to be documented.
The petition, filed by Sagar Kantilal Devre, alleges that approximately 600 individuals were detained on October 10 and 300 on October 11. The petitioner claims that those detained included bystanders, women, and a mother with a child.
Furthermore, the petition states that individuals were taken from their homes due to their names appearing in First Information Reports (FIRs) related to protests in July 2026, which have since been quashed by the Supreme Court. The petitioner is seeking the preservation of CCTV footage and police records, a list of all detained individuals, and an inquiry into the use of force by the police.
The Division Bench hearing the case consists of Chief Justice Tripathi and Justice Advait Sethna. The State's counsel requested additional time, noting that they had only recently received a copy of the petition.
