Previously, the Delhi High Court had declined to hear the members' plea, stating that only the club itself could challenge the government's actions. The members were advised to seek clarification from the Supreme Court to proceed with their case in the High Court.

The Supreme Court's decision allows the members to present their case before the Delhi High Court, provided that the opposing party does not raise objections regarding the maintainability or other legal aspects of the plea.

Lawyers representing the members informed the court that a committee nominated by the central government is currently managing the club and is therefore unable to legally contest the government's decision.

In related proceedings, the Centre had previously assured the Delhi High Court that no coercive action would be taken against the club concerning its eviction from the Safdarjung Road premises until September 16, 2026. The High Court was also hearing separate petitions seeking a stay on an eviction show-cause notice issued in June 2026.

The petition filed by Vipin Aggarwal and ten other members seeks to nullify a notification regarding the resumption of the property issued in May 2026 and the subsequent show-cause notice for eviction.
