The Delhi High Court has set aside an order from the Food Safety and Standards Authority of India (FSSAI) that directed Red Bull to cease using the term 'Energy Drink' on its caffeinated beverages. The court found that the FSSAI's June 30 order was issued without providing Red Bull an opportunity to present its case.
Justice Amit Mahajan's ruling also nullified all subsequent actions stemming from the FSSAI's initial directive, including a July 17 communication that instructed state and Union Territory food safety authorities to take enforcement measures. Red Bull had challenged both the June order and the July communication, arguing that the labeling restriction was imposed without a hearing.
The beverage company stated that it has been using the 'Energy Drink' descriptor in India since 2002. Red Bull contended that the FSSAI's June order was issued without a show-cause notice or a chance to be heard, and that the subsequent July communication led to the seizure of its products.
Red Bull also questioned the basis for what it perceived as a shift in the FSSAI's regulatory stance. The company cited a March 2024 advisory that reportedly clarified the use of 'Energy Drink' for licensed caffeinated beverages, along with a March 2024 press release from the Union Health Ministry and various existing licenses and clearances.
